Pharmaceutical Products

(Drugs, Vaccines & Serums – Chemicals – Pesticides – Radioactive Isotopes – Renal Diylsis )

يجب على لجنة البت والترسية أثناء دراسة منافسة المستحضرات الصيدلانية (الأدوية – الأمصال واللقاحات – الكيمياويات – المبيدات الحشرية – النظائر المشعة ـ محاليل الكلية الصناعية ) التقييد بالنصوص التالية :

 

      While studying the pharmaceutical products tender (Drugs, Vaccines & Serums – Chemicals – Pesticides – Radioactive Isotopes) the Tender Awarding Committee should stick to the following texts: 

أولاً : التعاريــــف:

 

First Definitions:

البنود المسجلة المعتمدة للدخول في مناقصات الشراء الموحد: هي تلك البنود المسجلة في الدول ذات المختبرات المرجعية أو مسجلة مركزياً بقاعدة بيانات المكتب التنفيذي والتي يتم تحديثها قبل مواعيد فتح المظاريف.

 

Registered Items legible for entering the Unified Purchase Tenders: include all items centrally registered in the Executive Board's database or registered in a referential-lab country, and have already been updated before envelops opening date.

الميزات والمواصفات الفنية: تتضمن ما يلي:

 

Technical Specifications and Features: include the following:

‌أ.  التسجيل المركزي أو التسجيل في ثلاث من الدول المرجعية.

 

(a)  Central registration or registration in three referential-lab countries.

 

 

‌ب.           طول فترة الصلاحية.

 

(b)  Validity and expiry period.

 

 

‌ج.  جودة العينة وشكل التعبئة.

 

(c)  Sample quality and packing shape.

 

 

‌د.   التزام الشركة بمواعيد التوريد.

 

(d)  Company's adherence to the defined delivery dates.

البنود الحساسة: وتشمل المجموعات العلاجية الآتية:

 

Sensitive Items: include the following:

‌أ.  الأدوية التي لها نطاق علاجي ضيق Narrow Therapeutic Index .

 

(a) Drugs with narrow therapeutic index which are taken orally (P.O)

 

 

‌ب.     الأدوية المشيدة بالتقنية الحيوية التي لا يمكن عمل تكافؤ حيوي لها وإنما تحتاج إلى دراسات سريرية أو ديناميكية .

 

(b) Drugs involving biological technology for which no bioequivalence can be made available, but rather need clinical or dynamic studies.

 

 

‌ج. الأدوية المماثلة التي لا يمكن عمل تكافؤ حيوي لها مثل الأدوية التي تؤخذ عن طريق الاستنشاق بالفم وبعض البخاخات الأنفية .

 

(c) Generic drugs for which no bioequivalence can be found, and are taken through mouth-inhalation or some nasal atomizers.

 

ثانياً : أسس البت والترسية:

 

Second: Principles of Tender's Awarding

تتم الترسية على العرض المطابق للشروط والمواصفات والأرخص والمسجل في دولتين من الدول ذات المختبرات المرجعية أو مسجل مركزياً.

 

Tenders are to be awarded to the conformant proposal which offers the lowest price and is centrally registered or registered in two countries with referential labs.

ينظر في الترسية على العرض المسجل في دولة مرجعية واحدة في الحالات الآتية:

 

A bid registered in one country with referential lab may be considered for awarding in one of the following cases:

‌أ. عدم وجود عرض مطابق مسجل في دولتين ذات المختبرات المرجعية أو مسجل مركزياً.

 

(a)          No conformant bid – which is centrally registered or registered in two countries with referential labs – is available among the bidders.

 

 

‌ب.     إذا كان سعر العرض المسجل في دولتين مرجعية أو مسجل مركزياً مبالغ به مقارنة بأسعار المرساة في المناقصات السابقة يتم مخاطبة الشركة للمفاوضة على تخفيض السعر وفي حالة عدم الموافقة على التخفيض أو ما زال الفارق كبير على العرض ويحق للجنة ترسية البند على العرض المسجل بدولة واحدة.

 

 

(b)          The bidder's prices offered in their conformant bids (that are centrally registered or registered in two countries with referential labs) are noticeably high in comparison with the prices of the previously awarded bids. In such case the supposedly awarded bidding company shall be asked to reduce its offered prices. If it does not agree, or its price (after reduction) is still high, the Committee shall have the right to award the tender to the bidder that is registered in one referential country.

يتم ترسية البنود المرتبطة فنياً كمجموعة واحدة على أن يتم احتساب التكلفة الإجمالية لهذه البنود والترسية على الأقل سعراً.

 

Technically-related items shall be awarded as one set, and the total costs shall be calculated for the whole set, then the tender shall be awarded to the lowest price.

في حالة تساوي الأسعار للبند بين أكثر من شركة تتم الترسية كما يلي:

 

In case prices are identical in more than one bid, the tender shall be awarded as follows:

‌أ.   إذا تساوى السعر بين شركات باحثة وشركات مثيلة (Generics)  تتم الترسية على الشركة الباحثة شرط أن يكون لمنتجها المبتكر.

 

(a)          In case the two identical prices are offered by a researching company and a generic one, the tender shall be awarded to the researching company provided that the tender involves its own patented product.

 

 

‌ب. في حالة تساوي الأسعار بين الشركات المثيلة (Generics) تتم الترسية بناءً على الميزات والمواصفات الفنية وفي حالة عدم وجود فروقات  تتم الترسية بعد المفاوضة مع هذه الشركات وفي حالة تساوي الأسعار بعد المفاوضة تتم الترسية بناءً على المبررات الفنية .

 

(b)          In case the two identical prices are offered by two generic companies, the tenders shall be awarded after considering the offered technical specifications and features. In case no significant difference could be highlighted, the tender shall be awarded according to the technical justification.

يقبل التركيز غير المسجل إذا كان البند مسجلاًً بتركيز مختلف وبنفس الشكل الصيدلاني .

 

Non-registered concentration shall be accepted in case the item is registered in different concentration in the same pharmaceutical form.

ينظر في قبول البند غير المسجل إذا كان عرض وحيد ومطابق والعينة جيدة.
