Principles of Tender's Awarding

For

Medical Supplies Tender

 

 

 (لوازم تجهيز المستشفيات، مستلزمات الكلية الصناعية ، لوازم رعاية الفم والأسنان، لوازم المختبرات الطبية وخدمات نقل الدم، لوازم جراحة العظام والعمود الفقري، لوازم التأهيل الطبي)

Hospitals supplies, Renal Dialysis Supplies, Dental and mouth care supplies, Medical lab. & blood transfusion services supplies, Orthopedic and spine surgery supplies, and medical Rehabilitation supplies

 

 

 

 

يجب على لجنة البت والترسية أثناء دراسة منافسة مناقصات المواد الطبية (لوازم تجهيز المستشفيات، لوازم رعاية الفم والأسنان، لوازم المختبرات الطبية وخدمات نقل الدم، لوازم جراحة العظام والعمود الفقري، لوازم التأهيل الطبي) التقييد بالنصوص التالية :

      During  studying the medical supplies competitive  biddings   (Hospitals supplies, dental and oral  care supplies, medical labs , blood transfusion services supplies, orthopedic , spinal surgery supplies, and medical habilitation supplies) , the Tender Awarding Committee      shall adhere  to the following texts:

التعاريــف :

 ‌أ- البند المجرب: أن يكون سبق ترسيته وتوريده خلال إحدى المناقصات الأربعة الأخيرة ولم تكن عليه ملاحظات فنية.

 ‌ب- البند المقيم : أن يكون قد تم تقييمه وفق آلية تقييم المنتجات المعتمدة وكانت نتيجة التقييم مقبولة .

Definitions:

a-     The Tested Item : It is the item that had been awarded, supplied through one of the last four tenders without any drawn technical observations.

b-     The Evaluated Item:  it is the item that had been already evaluated according to the approved products evaluation mechanism and the result was acceptable.

تتم الترسية على العرض المطابق للشروط والمواصفات والسعر الأرخص من مصدر الشركة المؤهلة كالتالي:

The tender shall be awarded in conformity with the conditions,   specifications and price of the cheapest source of the company's eligible as  follows :

‌أ-  البنود التي تحتاج إلى تقييم يجب أن تكون مقيمة في ثلاثة دول من دول الأعضاء ونتيجة التقييم مقبولة في دولتين على الأقل.

(a)   Items that need evaluation: They  must be assessed in three member countries and the result should be approved by at least two member countries.

 

 

‌ب- تجربة وتقييم المنتج لا تعني قبوله من قبل لجنة البت والترسية بشكل مطلق بل يعتمد ذلك على نوعية العينة المقدمة مع عرض الشركة، ومدى مطابقتها للنوعية التي تمت تقييمها أو تجربتها حسب شروط المناقصة.

(b)  Testing  and evaluating the product does not mean absolute approval by the Awarding Committee  but depends on the quality of the sample submitted with the company's offer, the extent of compliance to the quality that have been evaluated or tested according to the conditions of the tender.

 

 

‌ج- البنود التي لا تحتاج إلى تقييم يجب أن تكون العينة المقدمة للجنة جيدة ومستوفية لشروط المناقصة.

(c)  Items which do not need evaluation:   the sample provided to the Committee must be satisfactory the good meets the terms of the tender.

يمكن النظر في ترسية العروض الغير المجربة في حالة:

Offers for non tested items can be considered in the award in the following cases :

أ)  كونه عرض وحيد مطابق والعينة جيدة.

(a)   Being the only conformant offer, and its offered sample is satisfactorily good.

 

 

ب)                                            عدم وجود عروض مطابقة أو مجربة.

(b)  No other conformant or experimented offers are available.

 

(4)

يحق للجنة في حالة عدم وجود عروض مطابقة للمواصفات قبول المواصفة الأقرب للمطلوب.

In the absence of conformant offers, the Committee has the right to accept the proposal of the closest specification required.

في حالة تساوي الأسعار، يحق للجنة ما يلي:

In case of identical prices, the Committee  has the rights    as follows :

  ‌أ)   إذا تساوى السعر بين شركات باحثة وشركات مثيلة (Generics)  تتم الترسية على الشركة الباحثة شرط أن يكون لمنتجها المبتكر.

(a)           If the price of the offer presented by researcher companies and generics is equal, the item shall be awarded to the researcher company on condition that it is its innovative product.

 

 

 ‌ب)  في حالة تساوي الأسعار بين الشركات المثيلة (Generics) تتم الترسية بناءً على الميزات والمواصفات الفنية وفي حالة عدم وجود فروقات يتم المفاوضة مع هذه الشركات وتتم الترسية على العرض الأقل .

(b)           In the case of a tie between the prices of similar companies (Generics), award shall be based on the advantages and technical specifications .In the absence of differences , negotiations shall be made with these companies and the item  shall be awarded to the lowest price tender.

 

(6)

يحق للجنة استبعاد العرض في الحالات التالية:

The Committee  has the right to disregard the proposal in the following cases:

‌أ)   العينة المقدمة للجنة ليست في العبوة النهائية.

(a) sample submitted to the Committee is not in the final package.

 

 

‌ب)   العينة المقدمة للجنة غير جيدة.

(b)  The sample submitted to the Committee is not satisfactory.

 

 

‌ج)  ورود تقارير من دولتين من دول الأعضاء والجهات المشاركة بعدم جودة الصنف.

(c) Reports from two member countries and the participant bodies disqualifying the concerned items.

 

 

‌د)      أي مخالفات أخرى لشروط المناقصة
